At FORM, we believe your data should work for you.
As part of our commitment to transparency and fairness, this page explains how we handle the data generated through your FORM Smart Swim Goggles and FORM app, and how this aligns with the EU Data Act (Regulation (EU) 2023/2854). These principles apply to all users in the European Union (EU) and European Economic Area (EEA), and complement our Privacy Statement and Terms of Service.
1. Applicability of the EU Data Act
The EU Data Act (Regulation (EU) 2023/2854) applies to certain hardware products and associated services controlling those products, defined as “connected products” and “related services.”
This page provides information relevant to FORM Smart Swim Goggles and the FORM app.
2. What Types of Data are Generated?
FORM Smart Swim Goggles generate data to provide core functionalities, including:
- Device interactions: Button presses, screen views
- Swim session data: Lengths, distances, stroke type, stroke rate, pace, technique insights
- App data: Customization of dashboard metrics, settings
- Sensor & operational data: Raw sensor data (accelerometer, gyroscope, magnetometer), battery health, pairing status, firmware version
The types and volume of data generated can vary depending on device model, software version, settings, and user activity.
Some raw sensor data may be processed only temporarily on-device and then deleted. The goggles and app primarily use processed data (e.g., calculated pace and stroke metrics) for features.
Additional analytics data (e.g., crash logs, performance metrics) may also be generated.
3. Where and for How Long is Data Stored? For What Purposes?
- On-device processing: Most data is initially processed directly on your FORM Smart Swim Goggles.
- Cloud storage: Swim session data is synced to the FORM app and, if you are signed in, securely stored on FORM servers so you can review your swims and access features like HeadCoach™.
- Retention: Swim data and account data are retained as long as your FORM account is active.
- Account deletion: If you delete your account, your personal data and swim history are erased. Aggregated/anonymized data may be retained for analytics, performance improvement, and research purposes.
4. How Can You Access Your Data?
- In-app access: You can access your personal data and swim history at any time in the FORM app.
- Export: Request a full export of your data through account settings or by emailing privacy@formswim.com. Data will be provided in standard, machine-readable formats (e.g. CSV, FIT).
- Other data: Where additional performance or usage data is stored on the goggles or app, FORM provides tools to download or view this data in structured files.

6. How Can You Enforce Your Rights?

- You have the right to lodge a complaint with the competent authority designated under Article 37 of the EU Data Act in the Member State of your habitual residence, place of work, or establishment.
